Site Agreement

This Site Agreement (“Agreement”) governs your use of www.EastexProducts.com (“Site”) owned and operated by Eastex Products, LLC (“Eastex”). By accessing or using the Site, you agree to be bound by this Agreement.

1. Access and Use
1.1. You are granted a limited, non-exclusive, non-transferable right to access and use the Site for its intended purposes.
1.2. You agree to use the Site in compliance with all applicable laws and regulations and solely for lawful purposes.
1.3. You agree not to:
• Modify, adapt, translate, or reverse engineer any portion of the Site;
• Use the Site for any unlawful or unauthorized purpose;
• Transmit any viruses, worms, or other malicious code through the Site;
• Interfere with or disrupt the operation of the Site or the servers or networks used to make the Site available;
• Attempt to gain unauthorized access to the Site or any related systems or networks.

2. Intellectual Property
2.1. All intellectual property rights in the Site and its content are owned by Eastex or its licensors.
2.2. You agree not to remove, alter, or obscure any copyright, trademark, or other proprietary notices displayed on the Site.

3. Confidentiality
3.1. You may have access to certain confidential information of Eastex in connection with your use of the Site.
3.2. You agree to maintain the confidentiality of all such information and not to disclose it to any third party without Eastex’s prior written consent, except as required by law.

4. Privacy
4.1. Eastex may collect and process certain personal data in connection with your use of the Site.
4.2. Eastex agrees to handle any personal data collected in accordance with its Privacy Policy, which is available on the Site.

5. Termination
5.1. This Agreement shall remain in effect until terminated by either party.
5.2. Eastex may terminate this Agreement at any time without notice if you breach any provision of this Agreement.

6. Limitation of Liability
6.1. In no event shall Eastex be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with this Agreement.
6.2. Eastex’s total liability under this Agreement shall not exceed the amount paid, if any, to access the Site.

7. Governing Law and Dispute Resolution
7.1. This Agreement shall be governed by and construed in accordance with the laws of Indiana.
7.2. Any dispute arising out of or in connection with this Agreement shall be resolved through good faith negotiations between the parties.

8. Miscellaneous
8.1. This Agreement constitutes the entire agreement between you and Eastex with respect to the subject matter hereof and supersedes all prior and contemporaneous agreements and understandings, whether written or oral.
8.2. This Agreement may not be amended except by a written instrument signed by both parties.
